GENERAL CONTRACT CONDITIONS
1. The Lessor’s services that are included in the rental fee:
1.1 Port on water for a year with normal landing near the river wall, with a backpale.
- or storage of racing boat on the coast, with cranning.
- or storage volle on coast with boatyard usage.
1.2. In winter the de-icing of the watersuface around the boat with a water-circulating pupm that should be fitted on Lessee’s boat.
1.3. One club card with what:
-a car can be parked,
- the boat owner, his relatives and his guests’ entrance is secured.
- for two adults and their children the usage of indoor pool, sauna, fitness room.
1.4. At the port water, electricity-connection and TV antenna-connection is available.
1.5. The port has a club, WC, shower, camping kitchen, outdoor grill, plage, playground.
1.6. Guards secure the entire territory’s security.
2. The Lessor’s extra services that are not included in the rental fee:
2.1. Further club cards are available.
2.2. Hotel, conference rooms, tenniscourt, squashcourt, solarium, restaurants, sailing shop, supermarket, gas station, stb.
2.3. The Lessor does the servicing and the cranning for the servicing if required.
2.4. The storage of the boat in winter on coast is only secured by the Lessor if free capacity .
2.5. If the Lessee requires further electricity (e.g. for air conditioning) it must be declared. In this case an electricity-counter shuld be built in, and the used-up electricity is to be paid.
3. An agreement sould be made between the Lessor and the Lessee about the boat’s landing and storing place. The Lessor is allowed to change the places temporary in case of events, or if work is to be done at the port.
4. The territory of the port is closed and guarded. Although the Lessor does not take the responsibilty for the damages that might occur in cash or other personalty kept in the car or on the boat and for damages caused by unavertable disasters. Also, the Lessor is not responsible for damages that occur as a consequence of the Lessee behaving neglectfully or based on purposefulness or if the damage is coused by the Lessee contravening this agreement. In case of the damage is coused by a third person, the conpensation claim should be prooved by the Lessee. The Lessee is responsible for his guests.
5. The Lessee has to have valid ensurance, by singning this agreement the Lessee declaires that.
6. The Lessee is not allowed to do business at the territory of port, an also not allowed to put commertials on the landed boat. If required, a deal might be made with the Lessor about commertial intentions.
7. Newcomer conrtacters are only allowed to work at the territory of the port if the Lessor agrees.
8. The Lessor is allowed to use the left lending stage, naturaly by not hurting the Lessee’s right to use the landing stage.
9. The Lessee is not allowed to sublet the rental.
10. The Lessee can sell the leasing right to a third person or the leasing right can be inherited according to the current regulations, if the third person or the inheritant accepts the regulations listed in this agreement.
11. The Lessee possesses a leasing right for resingning the agreement for the next season for the same landing stage. The continuity is only provided if the Lessee signs the new contaract 3o days before the former one expires.
12. The holiday resort fee is not included in the rental fee.
13. Both the Lessor and the Lessee have to keep the Sailing Regulations and the Port Orders.
14. The Lessee is liable to fix the boat safely with proper ropes. The trail pore can be used with the ad-lib rubber or steel spring to decrease dinamic effects. Proper number of buffers must be placed on the left side of the boat (seen from port).
15. No interference is allowed on the equipment and the establishment of the port, it is forbidden to clinch or screw anything.
16. Only standard interface cabel is allowed to use with proper touch-protection.
17. At the port, only slow speed movements are allowed, without creating waves.
18. The moving rigging should be tied far from the mast, so that the wind cannot flap it. As always, but particulary from 1o pm to 8 am avoid all riots.
19. It is forbidden to pour waste, rubbish or oily water into the marina. Boat reparing jobs can be done in a restricted area and by not polluting the environment.
20. Dogs are only allowed to the port’s territory with leash. Dogs must not be walked on the plage.
21. Fishing is forbiden at the entire territory of the port.
22. Parties may denounce the leasing agreement in 15 days in case of significant infraction of the other party. In case of that the party at fault is not the Lessor, the rental fee will not be refounded. In case that the party at fault is not the Lessee, the time-propotional rental fee will be refounded.
23. In issues that are not regulated in this agreement Parties accept the jurisdiction of the Pest District Court (Pesti Központi Kerületi Bíróság) or the Metropolitan Court (Fővárosi Bíróság). Disputes arising from this Agreement shall be resolved by the Parties primarily through negotiation. For disputes that can not be settled amicably, the Parties accept the jurrisdiction of Veszpém City Court (Veszprémi Városi Bíróság).
